AIRPORT TAXI provides services based on the following GTC, service descriptions, and price lists. Divergent business terms and conditions do not apply, even if AIRPORT TAXI does not explicitly object to them. Deviations from these terms require the express written acknowledgment of AIRPORT TAXI. A contract is only formed if confirmed by AIRPORT TAXI.

Scope of Services

The scope of services is determined exclusively by the written order confirmation from AIRPORT TAXI or subsidiarily by the written offer from AIRPORT TAXI. Information contained in brochures, service catalogs, price lists, and similar materials is only binding if expressly referenced. Transportation is carried out in accordance with the provisions of the StVO (German Road Traffic Regulations) and the PbefG (German Passenger Transportation Act). Passengers must comply with instructions from AIRPORT TAXI or the chauffeur. If guests act against these instructions, or pose a hazard according to the StVO, or endanger road safety by interfering with the chauffeur, AIRPORT TAXI is entitled to exclude them from transportation. In this case, AIRPORT TAXI will charge the full fare, including the fixed price or kilometer-based price, and all ancillary and special services.

Airport Pickup (Airport Transfer)

Any change to the agreed pickup time, regardless of the reason, must be communicated to AIRPORT TAXI immediately. Damages resulting from failure to provide immediate notification shall be borne by the customer. The chauffeur from AIRPORT TAXI will be ready at the agreed pickup time at the respective meeting point of the airport terminal or the previously agreed-upon written meeting point, with a name sign or company logo (earlier or later readiness must be specified during booking) and will wait for up to 60 minutes without additional charges. A telephone number, through which the passenger can contact their chauffeur, is provided in the confirmation letter. If no contact with the passenger or the customer is made after the 60-minute waiting period has elapsed, the chauffeur will return to Vienna without the passenger. The service of AIRPORT TAXI VIENNA is then considered fulfilled, and the full fare becomes due for payment. Any additional waiting time requested by the customer will be charged according to the valid price list.

Prices

The prices include the statutory value-added tax at the respective legal rate. The prices valid on the day of booking confirmation apply. Flat rates not listed in the price list can only be agreed upon in writing and are only valid for the agreed travel date and rental period. Additional times and distances will be charged according to the valid price list. Additional costs due to delays shall be borne by the customer, unless the delays are due to fault on the part of AIRPORT TAXI or the chauffeur. The fare includes passenger transportation with normal luggage; the transport of bulky goods requires a separate agreement.

Payment Terms

AIRPORT TAXI reserves the right to request an advance payment of up to 50% of the total price before the start of the journey or to require a blank debit authorization form for a valid credit card issued to AIRPORT TAXI before accepting an order. Remaining payments are due within the periods specified on the invoice. The timeliness of the payment depends on the receipt of the amount at the unrestricted disposal of AIRPORT TAXI. If payment is made by check, the claim is only considered paid after final and complete credit. Payments are always applied to settle the oldest claim. If the customer is in default of payment, AIRPORT TAXI will charge interest – subject to the assertion of further default damages – at a rate of 5 percentage points above the base interest rate. A reminder fee of €10 will be charged for the second and each subsequent reminder. The customer reserves the right to prove that a lower loss has occurred.

Cancellations and Withdrawal

Cancellations are only effective if made in writing or, in the case of oral declarations, confirmed in writing by AIRPORT TAXI. The timeliness of written cancellations depends on their receipt by AIRPORT TAXI VIENNA. Cancellations up to and including 24 hours before the contractually agreed start of the journey are free of charge. For cancellations, AIRPORT TAXI will charge a portion of the base fare as compensation. This portion is:

* 50% for cancellations up to 12 hours
* 80% for cancellations up to 3 hours before the contractually agreed start of service fulfillment
* 100% for later cancellations and for no-shows.

AIRPORT TAXI will charge expenses regardless of the timeliness of cancellations if these have already been incurred. The customer is expressly permitted to prove that AIRPORT TAXI has incurred no or a lower loss. AIRPORT TAXI reserves the right to withdraw from the contract in whole or in part if the customer ceases payment, becomes insolvent, or if external circumstances indicate that the services are being misused, or if the customer violates obligations under these contract terms.

Customer Obligations and Liability

The customer must immediately inform AIRPORT TAXI of any changes to their name, (billing) address, legal form, and bank details. The customer is also obliged to provide the necessary information regarding passengers, time, and place of service provision. If the customer fails to provide immediate notification, they shall be liable for damages that could have been avoided with timely notification. The customer undertakes, also on behalf of the passengers, not to misuse the services of AIRPORT TAXI, in particular:
* not to disrupt or hinder the fulfillment of the service
* not to cause damages
* not to violate criminal regulations
* to strictly comply with the smoking ban in the vehicle
* not to refuse payment of the fare.

If a customer violates the aforementioned obligations, AIRPORT TAXI VIENNA is entitled to take all necessary measures to eliminate the misuse. In case of culpable violation, the customer shall be liable to AIRPORT TAXI for damages.

Liability of AIRPORT TAXI

AIRPORT TAXI shall be liable to the customer for damages – regardless of the legal grounds – only in cases of intent or gross negligence, as well as culpable violation of essential contractual obligations by AIRPORT TAXI, its legal representatives, or vicarious agents. Liability for injury to life, body, or health shall be governed by statutory provisions. For property damage, the liability of AIRPORT TAXI is limited to €1,000.00 per passenger. AIRPORT TAXI is not liable for any replacement or additional costs if the passenger is not picked up, this applies both for pickups to the airport and pickups from the airport. The vehicles are covered by liability insurance in accordance with the respective General Insurance Terms and Conditions. The customer is responsible for arranging any additional insurance. AIRPORT TAXI VIENNA is not liable for missed appointments and their economic consequences, insofar as these were not caused by AIRPORT TAXI. This includes, for example, delays caused by:

* Traffic jams, road closures
* Vehicle breakdowns or traffic accidents
* Bad weather

AIRPORT TAXI assumes no liability towards the customer or passenger for damages resulting from incorrect transmission of data by the customer.

Applicable Law and Place of Jurisdiction

Austrian law applies exclusively to all legal relationships between AIRPORT TAXI and its customer. The place of jurisdiction and performance is Vienna.

Partial Invalidity

If one or more of the above conditions are invalid, the remaining conditions shall remain unaffected. Statutory provisions shall replace invalid clauses.
